1. Meaning of Terms
1.1 The meaning of the words and phrases used in these Digital Product Terms and Conditions (the ‘Digital Product Terms’) shall have the meaning given in our ‘General Terms‘ unless otherwise defined in these Digital Product Terms. Words and phrases that are not defined in either the General Terms or these Digital Product Terms shall have their ordinary Australian English meaning.
1.2 The words ‘Website’, ‘User’ and ‘Copyright’ have the meanings given in our General Terms.
1.3 A ‘Digital Product’ has the meaning given in paragraph 2.
1.4 ‘Technology Markets’ involve the buy-side and sell-side dynamics for existing and emerging information technologies (IT) and IT services. In these markets, providers research, develop and apply electronic and online products and services to meet the current and projected needs of enterprise and government buyers. Sub-markets include hardware, software, services and communications. Our Practice Areas highlight the markets and use cases that we track.
1.5 A ‘Purchaser’ is a User of the Website who purchases a Digital Product directly from the Website.
1.6 A ‘Limited Exception’ to the non-refundable status of a Digital Product has the meaning given in paragraph 4.
2. Digital Product
2.1 A Digital Product sold on the Website (collectively, ‘our Digital Products’) is:
a) an intangible, non-physical, electronic file
b) provided in a common file format (such as PDF or in any other relevant format)
c) offered for purchase to Users directly from the Website only
d) delivered electronically to a Purchaser after the purchase, provided that the purchase is completed directly from the Website
e) informational and provided ‘as-is’ based on our research about the business trends and opportunities in one or more of the Technology Markets that we track
f) general in nature as we have not considered your specific objectives or needs
g) subject to the provisions of 2.3.
2.2 A Digital Product sold on the Website is not:
a) tangible nor physical in nature
b) executable code nor computer software that can run other executable code
c) considered sold unless and until the required payment is made by the Purchaser and the funds have cleared in our accounts.
2.3 The purchase of a Digital Product from the Website grants the Purchaser a limited, non-exclusive, revocable, non-transferable license to use the information contained therein for their sole personal or internal business purposes. The Digital Product and the intellectual property contained therein remains the property of Integral Advice and is subject to our General Terms including without limitation the Copyright provisions..
3. Refunds for Digital Products
3.1 By purchasing a Digital Product from the Website, the Purchaser agrees the entirety of the Digital Product Terms.
3.2 All Digital Product sales are final and non-refundable unless the Limited Exception applies.
3.3 By purchasing a Digital Product from the Website, a Purchaser agrees that they have had the prior opportunity to:
a) Review the product description(s) and any available examples or previews provided on the product page before making a purchase.
b) Email us at hello@integraladvice.com.au with queries and to seek clarifications about the Digital Product.
3.4 By way of explanation, the immediate access, downloadable nature and ease of replication (such as by making copies) of our Digital Products will, in most cases, prevent us from offering refunds for these products. These products are intangible, non-physical, electronic files of an informational nature. They are not computer software. Their intangible nature means they are unable to be returned in a manner normally applicable to the return of physical goods.
3.5 Users and Purchasers may wish to review information available about refunds for Digital Products from relevant independent sources (such as the Australian Competition and Consumer Commission via their website at https://www.accc.gov.au/).
4. Limited Exception
4.1 This Limited Exception applies only if we find the limited circumstances described in paragraph 4.2 are justified and in no other circumstances whatsoever.
4.2 We will consider a strictly limited exception to the provisions of paragraph 3 when all of the following conditions are met:
a) The Digital Product was purchased directly from the Website by the Purchaser, including without limitation the Purchaser making the required payment and the funds having cleared in our accounts.
b) The Digital Product can be demonstrated to either be:
i. faulty unless 4.3 applies and replacement(s) provided by alternate means (such as via email) remain faulty
ii. an unintentional duplicate purchase made by the Purchaser.
c) A refund request (the ‘Request’) is emailed to hello@integraladvice.com.au by the Purchaser within 14 days of the date the Digital Product was purchased.
d) Requests must include the tax invoice of the purchase(s), a clear problem description, whether a part or full refund is sought, and the evidence specified in 4.2(e).
e) Evidence of the fault or duplicate purchase. The evidence must demonstrate the fault or duplicate purchase to a reasonable standard. To avoid doubt the evidence must be at least relevant, timely, genuine, replicable and clear.
4.3 A fault caused by the Purchaser’s misuse or mishandling of the Digital Product, or by any part of the Purchaser’s computer including without limitation its hardware, software, internet connection, service subscriptions or connected devices, will render the Limited Exception void and the Digital Product will remain non-refundable. In such a case, the Purchaser is encouraged to seek remedy to the extent possible from the relevant provider related to that fault.
4.4 Within 14 days of a request made in accordance with 4.2 we will determine, on the balance of probabilities, whether it is justified. We will communicate our decision and our reasoning to you.
4.5 If a request made in accordance with 4.2 is justified and the problem cannot otherwise be remedied, then:
a) We will offer you a part or full refund based on the extent of the problem.
b) We will also offer you the choice of an account credit or a refund, noting that:
i. the value of any account credit or refund will not exceed the purchase price
ii. account credits are, except in the case of extenuating circumstances, generally available within 2 business days
iii. refunds are issued to the original payment method within 7 days.
4.6 If we find the refund request is not justified, you may appeal our decision by emailing complaints@integraladvice.com.au. You must do so within 14 days of our decision and provide relevant and genuine additional information to allow us to properly consider your appeal. We will address your appeal within 14 days. Decisions on appeal are final.
